Like Chapter 11, it forces creditors to the table for reasonable negotiations. Creditors would much rather deal with a Chapter 13 bankruptcy case than the liquidation that comes with Chapter 7. Here in Arizona, we see a lot of Chapter 13 Arizona bankruptcy cases because people believe that things will get better and would like to save what they own, if possible.

I personally view Chapter 13 as the bankruptcy for individuals who really don’t want to declare bankruptcy. Explaining Chapter 11 Bankruptcy Protections

Chapter 11 is used to reorganize businesses with heavy debts. It is not a liquidation like that of Chapter 7, and allows for the business or individual (more on that later) to restructure the debt where possible and create payment plans for those debts, as well as, plan for future profitability. There may be some liquidation as part of the plan (finding buyers for portions of the business), but in general it is the sort of protections used by companies that intend to emerge from bankruptcy as an entity. If an individual is also an entity, that individual may file for Chapter 11. In the case of Chapter 11 the creditors may file on behalf of the debtor to force them to the table. This happens infrequently as it creates an “automatic stay” on all debt collections, but it can happen (usually when there is some way in which the stand to gain from the filing). If you recall, the Obama administration forced the Detroit automobile companies into bankruptcy in order to “save” the businesses and force them into future profitability.

The goals of Chapter 11 are to position the company for future success, not to destroy the company entirely. When the reorganization plan is submitted to the courts, the creditors are classified into those that must be repaid (first) like governmental agencies, employees, and stockholders, those that hold secured claims, and those that hold unsecured debts. A repayment or discharge plan is created based on these classifications. Most creditors will accept the plan because it is better than what would happen should Chapter 7 happen. While there are some companies who do not complete Chapter 11 and end up in liquidation, a careful reorganization can make what was almost lost entirely successful again.

Chapter 7 bankruptcy is actually the type of bankruptcy that most people associate with the word. It is literally a fresh start. Chapter 7 bankruptcy protections are usually used by individuals whose debts are high and their property has been so devalued that they do not want to restructure the debt to save it. I saw a good many Chapter 7 cases as the housing crisis worsened and underwater mortgages became de rigueur. Here are some “facts” about Chapter 7 bankruptcy protections:

•Tax debts may be discharged if the tax debt is an income tax debt (versus payroll tax), if there was no willful evasion, the tax debt is over 3 years old, and/or the tax debt was assessed over 240 days before you file. Chapter 13 does not allow discharge of tax debt.
•Student loans could be discharged if the debtor can prove sufficient ongoing financial hardship.
•Mortgage, auto, and revolving debts listed in the filing can be discharged
•You walk away with nothing, but also owe nothing.

The choice between Chapter 7 and Chapter 13 sometimes boils down to a mental game. Many people who choose Chapter 7 protections choose it because they are mentally “done”. Their goose is cooked. They have been so overwrought by life, by creditors, by just existing that they want a complete and total fresh start. Bankruptcy can provide this. Contrary to popular belief you can even reestablish credit the day your case is concluded because your debt to income ratio is “nil”. Yes, bankruptcy goes on your credit report, but it is only one factor in the scoring. Chapter 7 can offer the overly debt-ridden a new chance at life.

The economic situation seemed to be somewhat improving the last four months and Tempe bankruptcy filings appeared to be slowing from a mad rush to just a rush. We weren’t working crazy hours just to keep up. I had started to feel a release from the tension of the past few years—that is, up until the US credit downgrade and the Dow’s drop. Suddenly, economists are saying we have a 1 in 3 chance of entering a recession (as if we weren’t in one before). What this troubling news means for folks in Tempe is unclear. The job situation is a mixed bag. Yes, there were new jobs, but there were also spate of layoffs. I know someone whose been laid off twice in the past three years so hearing there are “new” jobs only slightly raises interest around here in my office. As odd as it may sound coming from someone whose entire job revolves around the “business” of bankruptcy, I really wish the economic situation in the US would improve for all our sakes.

It is my hope that something comes out of Washington that will instigate job growth, but unless Washington is willing to put as much cash into the pockets of the middle class as it is interested in cutting taxes for the extremely wealthy it just isn’t going to happen. Economic recovery won’t occur without people buying the products these companies are being subsidized to sell. People need to spend money again and it won’t happen worrying about their mortgage, health insurance, and all the other realities that are only whispered about but never directly spoken aloud. Will things get better in Tempe bankrupcty? Sure, if there is a real plan in Washington to improve the situation of the middle class living in places like Chandler or Tempe.

I was very dismayed to hear this dismal bit of Chandler bankruptcy news: Atomic Comics is closing its doors and filing for Chapter 11. Atomic Comics has been in business for over 20 years. It’s store at the Chandler mall has been the site of several comic book signings that yours truly has participated in over the past decade, and Atomic Comic’s commitment to the industry and love of comic books even gave them a cameo in the recent Kick Ass movie. As an Arizona bankruptcy attorney and as a comic book fan, hearing that Atomic Comics is closing its doors really saddens me. Mike Malve, the owner, cited the economic downturn and loss of inventory due to accident as reasons behind the filing.

What saddens me further is reading that his family’s home will also be lost to this bankruptcy filing. Like many business owners he leveraged family assets to help pay for the business and its expenses. This brings me to points I made in earlier blog posts and that is, namely, that when people have no money to spend—either due to saving (see “Paradox of Thrift”) or forced conservation (current economic state) then the economy will continue to spiral down without recovery. I’ve explained to people before that bankruptcy allows people to become consumers again. Suddenly, they aren’t weighed down by debts they just cannot repay and can buy things like comic books, new clothing for their children, better food, and other products that would kick start the economy. Chandler was very lucky to have a store like Atomic Comics and I, for one, am unhappy to hear about this particular bankruptcy filing.

Mesa Bankruptcy News and Speculation for the Future

I was briefly overjoyed by the Mesa bankruptcy news that came out last month citing that fewer families have filed for bankruptcy since last year at this time. The reasons cited for fewer filings weren’t exactly “good”, but the news itself seemed to please the movers and shakers here in Mesa. The speculation is that the tightening of credit has forced people to borrow less, ergo they are less “in debt” than before. However, there is less funds available to spend on anything other than necessities. This is good for Mesa bankruptcy numbers, but lack of consumer spending is terrible for the economy. People here in Mesa are “holding” for the moment, but all of us are well-aware that these numbers may change shortly with the recent S&P downgrade, stock market crash, and looking recession. All it would take is job loss (which is on the horizon) or a medical bill that isn’t insured to push pretty much anyone over the debt ledge.

I am glad that the powers that be are optimistic about these latest statistics, but I’d be even more glad if there was a plan to get people back to work, lower insurance costs, and fix the mortgage and housing crisis. I live here. I know who files for Mesa bankruptcy. I know it’s not people who have been lower income their whole life, or people that were frivolous spenders. It’s people who were middle class , had a job loss, and then watched their mortgage modification become denied, creditors only raise interest rates, and/or had a medical bill hit that they couldn’t cover without insurance. I hope and pray that the economy recovers and that the reason for a decrease in Mesa bankruptcy filing is because people are back to work, mortgage lenders become more lenient, and the cost of medical procedures drops.

As an Arizona bankruptcy attorney it’s my job to keep abreast of financial news, and recently there has been a lot of it. Unfortunately, it’s been all bad. The financial complications with the downgraded S&P and the stock market dive will certainly have an impact on local economies shortly—if not already. Arizona has been struggling the past few years from the last “non-recession”. Home prices fell, mortgages are underwater, and unemployment has affected almost every family that I know in some way…and now financial analysts are saying that there is a 1 and 3 chance of yet another recession to begin within the next few months. I understand the technical definition of a recession, but the reality is that Arizona and the rest of the country has been living in one for the past six years. The number of Arizona bankruptcy cases certainly didn’t seem to concur with Washington’s estimation that we weren’t in a recession! I fully expect to see even more inquiries into Chapter 7 and Chapter 13 within the next few months based on recent economic news.
